This live online CPD event offers mediators the opportunity to observe a realistic family mediation role play centred on property disputes under ToLATA.
The session is structured as professional training through simulation rather than performance. The role play reflects genuine mediation practice, featuring authentic dialogue, clear professional boundaries, and mediator-led interventions that support meaningful learning. An experienced observer will provide commentary via the webinar chat, drawing attention to mediator techniques, decision-making, and key moments for reflection.
The scenario focuses on Fatima and Jack, who were in a relationship for 15 years but never married. They jointly purchased a home with a mortgage; however, inconsistent financial contributions led Fatima to borrow money from her parents. Jack has mobility needs, and the property has been adapted accordingly. Following the breakdown of the relationship after Fatima’s affair, she now wishes to sell the property and move forward, while Jack is determined to remain in the home.
During her MIAM, Fatima disclosed that she is pregnant with Jack’s child — information he is currently unaware of. This will be their first joint mediation session.
Themes explored include property rights for unmarried couples, balancing housing needs with financial fairness, the management of confidential MIAM disclosures, and the emotional dynamics of guilt, dependency, betrayal, and uncertainty about the future.
Attendees will have the opportunity to observe how a mediator:
• Establishes clarity around the scope of ToLATA within mediation
• Balances housing needs alongside questions of financial contribution and fairness
• Manages confidential MIAM disclosures while maintaining trust in the process
• Navigates heightened emotions linked to betrayal, vulnerability, and dependency
• Structures complex financial discussions while supporting forward-focused dialogue
There will be dedicated time for audience questions, allowing participants to deepen their understanding through guided discussion and professional reflection.
